EzyTise LLC, operating as “Simplfy.AI” (California SB 243 and Comparable Regulations)

The following sections constitute a unified Terms of Use package addressing all safety, compliance, and operational requirements applicable to the AI-powered conversational systems and companion chatbot services offered by EzyTise LLC, operating as “Simplfy.AI” (“EzyTise,” “Simplfy.AI,” “we,” “our,” or “us”). These terms are fully incorporated into the EzyTise Terms of Use and govern all access to and use of our AI-driven chatbots, virtual assistants, and conversational interfaces (“Chatbot Services”).

By accessing or using any AI-driven chatbot, virtual companion, automated assistant, or conversational interface (collectively, the “Chatbot Services”), you (“User” or “you”) agree to the terms of this Addendum in addition to all obligations set forth in the Agreement.

1. Nature of the Chatbot Services

1.1 AI-Generated Interactions: The Chatbot Services utilize artificial intelligence to generate responses. Interactions with the Chatbot Services are not provided by a human, and Users should not rely on the Chatbot Services for professional advice, emergency intervention, or crisis support.

1.2 No Medical, Psychological, Legal, or Safety Advice: The Chatbot Services do not provide licensed medical, psychological, legal, or crisis-intervention advice. Users should not rely on the Chatbot Services for guidance related to self-harm, mental health emergencies, or any safety-critical scenario.

2. User Age Requirements & Minor Protections

2.1 Age Verification: EzyTise implements reasonable age-assurance mechanisms to determine whether a User is under eighteen (18) years of age. Accurate age information must be provided during account creation or access.

2.2 Use by Minors: If EzyTise becomes aware, or has reason to believe, that a User is a minor, the Chatbot Services will apply additional safeguards, including recurring disclosures, interaction reminders, and content restrictions required by applicable regulations.

2.3 Parental Responsibility: Parents and legal guardians are responsible for monitoring the use of the Chatbot Services by minors under their supervision.

3. Mandatory AI Disclosures

3.1 AI Identity Notifications: The Chatbot Services will display conspicuous disclosures informing Users that they are interacting with an AI system whenever there exists a reasonable likelihood of confusion.

3.2 Non-Human Interaction: Users acknowledge and agree that all communications through the Chatbot Services are computer-generated and not provided by a live human operator.

4. Content Restrictions & Safety Measures

4.1 Prohibited Content Generation: Users may not request, solicit, or attempt to generate content through the Chatbot Services that violates safety protocols, including but not limited to:
- (a) self-harm or suicidal content;
- (b) explicit sexual content involving minors;
- (c) violent or dangerous conduct.

4.2 Automated Filtering: EzyTise employs advanced content-filtering technologies to prevent the Chatbot Services from generating harmful, unsafe, or prohibited content. These protections operate automatically and may restrict or interrupt the User experience.

5. Crisis Detection & Emergency Redirection

5.1 Automated Crisis Response: If the Chatbot Services detect expressions of suicidal ideation, self-harm, or similar crisis-related signals, the chatbot may immediately interrupt the interaction and display an emergency notice.

5.2 Referral to Crisis Services: In such circumstances, the User will be directed to crisis intervention resources such as the 988 Suicide & Crisis Lifeline or other appropriate services.

5.3 Limitation of Services: EzyTise may temporarily suspend or restrict the User’s ability to continue interacting with the Chatbot Services until the emergency notice is acknowledged.

6. User Conduct & Responsibilities

6.1 User Obligations: Users agree:
- (a) Not to misuse or attempt to bypass the safety mechanisms of the Chatbot Services;
- (b) Not to input harmful, abusive, or crisis-related prompts for non-emergency, malicious, or manipulative purposes;
- (c) To use the Chatbot Services in compliance with all applicable laws and regulations.

6.2 Misuse of Chatbot Services: Misuse, manipulation, or intentional triggering of crisis-response systems may result in account suspension or termination.

7. Data Handling & Privacy Compliance

7.1 Safety-Related Data: EzyTise may collect and retain safety-related data, including crisis detections, content filtering events, and protocol activations as required for compliance with applicable laws.

7.2 Privacy Policy Integration: All personal data processed through the Chatbot Services is governed by the EzyTise Privacy Policy, including any sections addressing safety data, anonymization, and regulatory reporting.

8. Regulatory Reporting & Compliance

8.1 Annual Reporting Requirements: Beginning July 1, 2027, and annually thereafter, EzyTise may be required to submit certain anonymized crisis-related metrics and safety-protocol descriptions to government authorities as required by SB 243 or comparable laws.

8.2 Compliance with Future Regulations: Users acknowledge that EzyTise may update, modify, or expand safety functions to comply with evolving federal, state, or international regulations governing AI companions and digital assistants.

9. Modifications to This Addendum:

EzyTise reserves the right to modify, revise, or update this unified Terms of Use package at any time. Changes take effect upon posting unless otherwise required by law. Continued use of the Chatbot Services constitutes acceptance of all updates.

10. Acceptance of Terms:

By accessing or using the Chatbot Services provided by EzyTise LLC, operating as “Simplfy.AI,” the User acknowledges and agrees to this Terms of Use Addendum, along with all other applicable sections of the Agreement, the Privacy Policy, and any incorporated policies.

11. Acceptance of Unified Terms: By accessing or using the Chatbot Services provided by EzyTise LLC, operating as “Simplfy.AI,” you acknowledge and agree that:
• You have read this unified Terms of Use package;
• You understand your responsibilities;
• You agree to abide by all safety, conduct, and compliance requirements described herein;
• You accept all obligations in the main Terms of Use and Privacy Policy.
